Profile

About

I am a clinical pharmacist and independent prescriber with 26 years’ experience across general practice, out-of-hours urgent care, PCT medicines management and community pharmacy. I was among the first clinical pharmacists embedded in UK general practice.

I am an External Professional Adviser to the Public Service Ombudsman (England), and I am completing the Bond Solon Civil Certificate in Expert Witness Practice (Cardiff University).

Duty to the court I understand and accept that my overriding duty as an expert is to the court, in accordance with CPR Part 35 and its Practice Direction.

Who I am. Expert witness services are provided by Scriberpharm Ltd, which is the data controller for personal data processed in connection with this work. Contact: ugonma@prescribingexpert.co.uk.

What I collect. When you contact me, I hold your name, contact details, firm and the information in your enquiry. If I accept an instruction, I receive case papers from the instructing party, which may include medical records and other health information about the people involved in the case.

Why, and on what basis. I use enquiry details to respond to you, check conflicts of interest and agree terms (legitimate interests, and steps towards a contract). I use case papers only to prepare expert evidence in that case (performance of my contract with the instructing party, and legitimate interests in the conduct of legal proceedings). Health information is processed where it is necessary for the establishment, exercise or defence of legal claims, or whenever courts are acting in their judicial capacity (UK GDPR Article 9(2)(f)).

Where the information comes from. Information about claimants, patients and clinicians normally comes from the instructing solicitor or party, not from the individuals themselves.

Who I share it with. The instructing party, other parties and experts in the case as directed, and the court or tribunal. I do not sell personal data or use it for marketing.

How it is protected. Case papers are stored securely, with access restricted to me, and are transferred only by secure means agreed with the instructing party.

How long I keep it. Case papers are returned or securely destroyed when the case concludes. My report and core correspondence are kept for six years after the case closes, to deal with any further queries or claims. Enquiries that do not lead to an instruction are deleted within 12 months.
